Service Description: DiverGO is an online platform that allows users to book water activity-related services, including but not limited to scuba diving, freediving, snorkelling, stand-up paddle boarding, kayaking, surfing experiences, related professional courses, and equipment rentals. These services are uploaded and provided by independent merchants. DiverGO acts only as an intermediary and does not provide, manage, or take responsibility for the services offered by merchants.

1. Introduction

These Terms and Conditions ("Terms") govern your use of the DiverGO platform ("Platform"). By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, you must not use the Platform.

2. Definitions

• "Platform" refers to DiverGO's website and services.
• "User" refers to any individual or entity using the Platform to book services.
• "Merchant" refers to any individual or entity offering services on the Platform.
• "Services" or "Experiences" refer to the water activity-related offerings provided by Merchants, including scuba diving, snorkelling, freediving, stand-up paddle boarding, kayaking, surfing experiences, courses, and equipment rentals.

3. Services Provided

DiverGO provides an online platform where Merchants can list their Services and Users can book them. DiverGO does not provide, own, or manage any of the Services listed on the Platform. All Services are provided directly by the Merchants, who are solely responsible for their quality, safety, and compliance with applicable laws.

4. User Responsibilities

• Users must provide accurate and complete information when creating an account or making a booking.
• Users must comply with all policies, terms, and conditions set by the Merchants for the Services they book.
• Users acknowledge that DiverGO is not responsible for the quality, safety, or legality of the Services provided by Merchants.
• Users agree to use the Platform only for lawful purposes and in accordance with these Terms.

5. Merchant Responsibilities

• Merchants are solely responsible for the accuracy, quality, safety, and legality of the Services they list on the Platform.
• Merchants must ensure that their listings are up-to-date and comply with all applicable laws and regulations.
• Merchants are responsible for managing and resolving any issues, complaints, or disputes arising from their Services.
• Merchants must provide clear and accurate terms, including cancellation and refund policies, for their Services.

6. Liability Disclaimer

DiverGO acts solely as an intermediary and does not provide, manage, or support any services listed on the Platform. To the fullest extent permitted by law, DiverGO assumes no responsibility for:

• The quality, safety, legality, or accuracy of services provided by merchants;
• Any damage, loss, or injury resulting from the use of services booked through the Platform;
• Any disputes between users and merchants.

Users and merchants agree to release DiverGO from any claims, demands, or damages arising in connection with the services.

7. Payment Terms

• All payments for Services are made directly to the Merchants or through a third party payment processor as specified on the Platform.
• DiverGO may charge a service fee for the use of the Platform, which will be clearly disclosed at the time of booking.
• Users are responsible for ensuring that their payment information is accurate and up-to-date.

8. Cancellation and Refund Policy

• Cancellation and refund policies are set by each Merchant and may vary depending on the Service.
• Users must review and agree to the Merchant's cancellation and refund policy before booking.
• DiverGO is not responsible for processing refunds or handling cancellation requests; these must be managed directly with the Merchant.

9. Intellectual Property

All content, trademarks, logos, and intellectual property on the Platform are owned by DiverGO or its licensors. Users and Merchants may not use, reproduce, or distribute any content from the Platform without prior written permission from DiverGO.

10. Privacy Policy

DiverGO collects and processes personal data in accordance with its Privacy Policy, which is available on the Platform. By using the Platform, you consent to the collection and use of your data as described in the Privacy Policy.

11. Dispute Resolution

Any disputes arising from these Terms or the use of the Platform shall first be attempted to be resolved through good-faith negotiations. If negotiations fail, the dispute shall be submitted to mediation or arbitration in accordance with the laws of the jurisdiction specified in Section 13.

12. Amendments

DiverGO reserves the right to amend these Terms at any time. Any changes will be posted on the Platform, and continued use of the Platform constitutes acceptance of the amended Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Estonia, without regard to its conflict of law principles.

14. User Conduct

Users and Merchants agree not to engage in any illegal, abusive, or harmful activities on the Platform, including but not limited to fraud, harassment, or the transmission of malicious software.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

16. Entire Agreement

These Terms constitute the entire agreement between DiverGO and its Users and Merchants, superseding any prior agreements or understandings.

18. Language

These Terms are provided in English, Chinese, Japanese, and Korean. In the event of any discrepancy between the versions, the English version shall prevail.

19. Currency Conversion and Rounding

Prices are stored in our base currency (HKD) and displayed in your selected currency using our published exchange rate. The final amount charged is rounded to each currency's native precision — whole units for TWD, JPY, KRW, and IDR; two decimal places for HKD, USD, EUR, and other currencies with minor units. Any rounding difference versus the precise converted value does not exceed 0.5 of the smallest currency unit per transaction and is absorbed by DiverGO. Your bank or card issuer may apply its own conversion rate when settling the transaction on your statement.

20. Dive Coins Rounding

Dive Coins are earned, stored, and redeemed in whole-number increments. Where a transaction calculation produces a fractional coin value, we round down (floor) at the time of credit. For example, a booking that would earn 3.54 Dive Coins will credit 3 Dive Coins to your balance. This ensures your displayed balance always matches the exact integer count on the ledger.

21. Dive Coins Redemption Limits

To keep the loyalty programme sustainable, redemption is subject to two limits: (a) minimum basket — bookings below HK$100 are not eligible for Dive Coins redemption; (b) per-booking cap — no more than 10% of any single booking's total may be paid with Dive Coins. Both limits apply before promo or coupon discounts. Unused coins remain in your balance for future bookings, subject to the expiry rules in your Dive Coins dashboard.

By using the DiverGO Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
